Disputed Wills and Trusts
When there are disputes between the heirs of a deceased person or beneficiaries of a trust Mr. Steele's priority is to understand and protect the client’s interests. Since other family members are often involved, Mr. Steele's goal is to settle Trust and Estate Disputes without litigation. If no settlement can be reached, then it is necessary to bring legal action to determine whether or not the will, trust, or estate plan, or other disputed action is valid, and the estate is being correctly managed and distributed. Ethan has extensive experience dealing with disputes between heirs of a deceased person or beneficiaries of a trust. Including, but not limited to the following claims:
- That the decedent’s estate plan or other actions (adding names to an account, etc.) was the result of a mistake, or misunderstanding of their intent.
- That the decedent lacked capacity to make the estate plan, including age, illness and mental conditions.
- That the decedent’s will, trust, or other actions was the result of “undue influence” being exerted upon them, and does not truly reflect their wishes.
- That the trustee or fiduciary is mismanaging the estate assets.
